With the assistance of learned Counsel for respondent No.5, who is appearing for formal party, I have gone through the application under Order 7 Rule 11 of the Code of Civil Procedure for rejection of plaint and the impugned order. In view of the fact that nature of the property is in dispute. As such, it is required to be adjudicated by adducing evidence. I find that the learned Civil Judge Senior Division, Nagpur has not committed any error in rejecting the application under Order 7 Rule 11 of the Code of Civil Procedure.

As such, there is no error in the impugned order. Accordingly Civil Revision Application stands dismissed.
