Learned counsel Shri Thakre appearing on behalf of Shri Qazi, learned counsel for the petitioner submits that the present petition was filed challenging the election of the returned/elected candidate - respondent no. 3. He further submits that by the passage of time, the petition has become infructuous.

Learned Additional Government Pleader on behalf of respondent no. 2 submits that as the petition was pending before this court, electronic voting machines were sealed. He further submits that in view of the submissions of learned counsel for the petitioner, authority be permitted to open the seal of those electronic voting machines so that these machines can be used for further purposes in ensuing elections. In view of the statement made by the learned Additional Government Pleader, authority is permitted to open the seal of electronic voting machines and use the same for election purposes in .....2/-
