IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH, NAGPUR.

CRIMINAL APPLICATION NO.675 OF 2016 Sachin s/o Durgadas Kothari, Narendra Nagar, Nagpur. -vsState of Maharashtra, Thr. PSO PO Ganeshpeth, Nagpur and anr. ------------------------------------------------------------------------------------------------------------------------- Office notes, Office Memoranda of Coram, appearances, Court's orders Court's or Judge's Orders.

or directions and Registrar's orders.

Shri R. S. Rathod, Advocate for applicant.

Shri J. Y. Ghurde, APP for respondent No.1/State. CORAM : B.P.DHARMADHIKARI & A.S.CHANDURKAR, JJ.

DATE : September 23, 2016 By showing that supplies are being obtained for Government hospitals by preparing documents/forging documents it is alleged that applicant has mislead the respondent No.2 into supplying medicines to it at subsidised rates. Applicant and respondent Nos.2 have compromised the matter.

Learned APP for respondent No.1 points out that application for anticipatory bail has been rejected by the learned Single Judge of this Court and further investigation is going on.

When the Government's name and papers have been misused, we fail to understand how the applicant and respondent No.2 can enter into such compromise. We find

2/3 that the matter needs to be investigated into by respondent No.1, if necessary, not only against the applicant but also respondent No.2.

Accordingly application is disposed of.
