Heard learned counsel Shri L.M.Ghongade for the applicant and learned Additional Public Prosecutor Shri S.M.Ghodeswar for the State.

The applicant is apprehending his arrest in connection with Crime No.448/2019 registered with Arni Police Station, Taluka Arni, District Yavatmal for offences under Sections 354(D) and 509 of the Indian Penal Code and under Section 12 of the Protection of Children from Sexual Offences Act, 2012.

Reply filed on behalf of the prosecution opposing the present application for grant of pre-arrest bail shows that Sau.Sunita Sanjay Rathod lodged report. As per the report, victim her daughter is studying in 9th Standard at Bhagatsingh Vidyalaya, village Arni, District Yavatmal. According to the reply, on 18.7.2019 when victim left her house on her bicycle for school and when she was returning from her school, the present applicant .....2/-

followed her and uttered objectionable words. 4.

According to the reply, as per interim protection granted by this Court in favour of the present applicant, the applicant attended the police station from 18.9.2019 to 25.9.2019 and Investigating Officer seized motorcycle used by the applicant in the crime. 5.

In view of nature of accusations made against the applicant in the report and the fact that motorcycle used by the present applicant in crime has already been seized, custodial presence of the present is not necessary. Hence, I pass following order:

ORDER

(a) The criminal application is allowed.

(b) In the event of arrest of applicant-Karan s/o Mangilal Jadhav, in connection with Crime No.448/2019 registered with Arni Police Station, Taluka Arni, District Yavatmal for offences under Sections 354(D) and 509 of the Indian Penal code and under Section 12 of the Protection of Children from Sexual Offences Act, 2012, the applicant be released on bail on he executing a P.R.Bond in the sum of Rs.25,000/- with one solvent surety of the like amount.

(c) The applicant is directed to attend the police station once in a week i.e. on every Friday and shall be in the police station from 9:00 a.m. to 1:00 p.m., till filing of chargesheet.

(d) The applicant shall not in any way try to contact the .....3/-

first informant or the victim.

(e) With this, the criminal application stands disposed of accordingly.
