IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH : NAGPUR WRIT PETITION NO. 76 OF 2020 Gopal w/o Vithoba Rajurkar -- Petitioner/s Vs.

The State of Maharashtra and others -- Respondent/s Mr. Bhushan Dafle, Advocate for Petitioner.

Ms. Mayuri Deshmukh, AGP for Respondent Nos.1 to 5. CORAM : NITIN JAMDAR & ANIL L. PANSARE, JJ.

DATE : 15 FEBRUARY 2022 P. C. :

Heard learned counsel for the Petitioner.

2.

The Petitioner is seeking interest on delayed payment of his Provident Fund from March 2017 to 18 July 2018. The Petitioner has placed reliance on a Government Resolution dated 22 November 1994 in that regard. This Resolution though states about the interest on delayed payment of Provident Fund, enumerates contingencies in which such interest is not liable to be paid. Therefore there will have to be an inquiry as to whether interest is payable or not and straightway a direction as sought for cannot be issued.
