This is an application for anticipatory bail. Heard Mr. Shinde, learned Adv., for the applicant, and Mrs. Deshmukh, learned APP for respondent-State. The First Information Report is lodged by the father of the prosecutrix. It is dated 31st August, 2015. It is seen from the First Information Report that the same is lodged against five persons. Out of them, two persons named are the present applicant and one Shrawan Babarao Pawar. Shrawan Babarao Pawar is shown as Non-applicant No.2 in the complaint. The First Information Report shows that specific allegations made
made against Non-applicant No.2 - Shrawan Babarao Pawar. Learned APP submitted that there are allegations against the present applicant also in the statements of the eye-witnesses. Their statements reveal that those allegations are general in nature and specific allegations are made against Shrawan Babarao Pawar. In that view of the matter, the present application needs to be allowed. Hence the following order:-
O R D E R
[a] Criminal Application [ABA] No. 529 of 2015 is allowed.
[b] In the event of his arrest in connection with Crime No. 309/2015 registered with Arni Police Station, Distt. Yavatmal, for the offences punishable under Sections 354-A, 354-B, 504, 506, 143 and 147 of Indian Penal Code, 8 of the Protection of Children from Sexual Offices Act read with Section 3 (1) (x) & (xi) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, the applicant Sunil Vasanta Rathod be released on bail on he executing a Personal Bond of Rs. 25,000/- [rupees twenty-five thousand only] with one solvent surety in the like amount.
[c] The applicant shall attend Arni Police Station,
Distt. Yavatmal, twice a week on every Wednesday and Thursday till filing of a charge-sheet and he shall be in the Police Station from 2.00 p.m., to 5.00 p.m.
[d] That, after filing of the charge-sheet, the Applicant shall continue to attend Police Station once in a month, I..e., on last Saturday of each month and he shall be in the Police Station from 2.00 p.m., to 5.00 p.m., till framing of the charge.
With this, the application is allowed and disposed of.
