DATED : 2 nd January 2020 The petitioner has prayed for reliefs as per the following prayers:
"(a) Quash and set aside order dated 15/05/2016 (annex IV) and 21/09/2016 (at annex VIII) passed by respondent No.2, by which the Petitioner's services as Anganwadi Sevika came to be discontinued , in the interest of justice.
(b) Direct respondent No.2, to continue the services of Petitioner on the post of Anganwadi Sevika in Anganwadi No.6, Palasgaon Jat, Tahsil Sindewahi, till the appropriate decision is taken by the government, on such terms and conditions, in the interest of justice.
(c) During the pendency of instant
2 19.wp7720.2017 application, direct respondent no. 2, to continue the services of Petitioner on the post of Anganwadi Sevika in Anganwadi No.6, Palasgaon Jat, Tahsil Sindewahi, till the appropriate decision is taken by the government, on such terms and conditions, in the interest of justice."
2] Learned A.G.P. and learned Advocate for respondent Nos. 1 and 2 pointed out the judgment given by the Division Bench of this Court, in the case of Vidya W/o. Vishnu Vanare .v/s. State of Maharashtra and another reported in 2011 (2) Mh.L.J.221, in which it is held that the employee like the petitioner can approach the Labour Court for seeking the reliefs as sought by the petitioner.
3] In view of the submission made on behalf of the respondents that the petitioner has alternate efficacious remedy available to seek redressal of her grievance, the learned Advocate for the petitioner, on instructions, seeks permission to withdraw the petition with liberty to avail the alternate remedy.
4] The writ petition is disposed, as withdrawn, with liberty as prayed for.
