On the allegations of the complainant that on false promise of providing employment the accused persons have duped the complainant, Crime No. 2792 of 2021 was registered with the Police Station, Gadge Nagar, Amravati city on 07/11/2021 against five accused persons including the applicant for the offences punishable under Sections 420, 468, 469, 471 of the Indian Penal Code. 3.

The applicant is wife of main accused, who has promised the complainant to provide employment and who has received the amount. The only allegation against the applicant is that on one occasion, when the main accused was out of station, as per his directions, the amount was handed over by the complainant to the applicant.

This Court on 22/12/2021 granted ad-interim anticipatory bail to the applicant and accordingly the applicant attended Police Station and there is no complaint about misuse of liberty by the applicant.

The learned A.P.P. opposed the application saying that prima-facie material is there to show involvement of the applicant in the alleged offence. 6.

On perusal of the case diary and after going through the contents of the First Information Report, prima-facie, it can be said that there are no allegations against the applicant that she promised any employment to the complainant or received the amount against the same. Thus, prima-facie, I do not find any incriminating material against the applicant. Hence, I pass the following order: i) The application is allowed.

ii) Order dated 22/12/2021, granting ad-interim anticipatory bail to the applicant, is confirmed with modification that the applicant shall attend the concerned Police Station as and when her presence is required. The application stands disposed of accordingly. JUDGE RRaut..
