Heard learned Counsel for the Applicant/Appellant, who submitted that the Appellant is poor and due to his financial condition he could not engage the private Counsel within time, and therefore, the delay is caused.

Learned APP, strongly opposed for the same as there is no justifiable reason.

On perusal of the Application and the submissions made by the learned Counsel for the Appellant, if the delay is not condoned the statutory right of the present Appellant to
