This is an application for withdrawal of remaining 50 % compensation amount lying deposited in this Court. The appellant has deposited entire decreetal amount in this Court in terms of order of this Court. The respondent No.1 had already withdrawn the 50 % of the amount.

Learned Advocate for the appellant submits that subject to appropriate condition the respondent No.1 may be allowed to withdraw some amount.

In view of the reasons stated in the application, the application is allowed. The respondent No.1 is allowed to withdraw 35 % of the total decreetal amount with accrued interest on furnishing solvent surety. 5.
