Shri Karmarkar, learned counsel for the applicant submits that the present challenge has been filed on the basis of copy of FIR available on website. Later on it is learnt that it is not complete FIR. He fairly states that the charge sheet has also been presented in the matter. He, therefore, seeks leave to effect appropriate amendment. Shri V.A. Thakare, learned APP for the respondents is opposing the request.
This Court has not issued any notice in the matter and merits of the controversy are still not gone into. In this situation, we grant leave to the applicant to present appropriate challenge afresh after obtaining all the relevant papers in the matter. Grant of leave does not in any way prejudice the defences available to the respondents in the matter.
Accordingly, with leave to the applicant, we dispose of the Criminal Application. No costs. JUDGE JUDGE *GS.
