The learned advocate for the applicant/ appellant has submitted that the complainant turned hostile and there is no evidence on record to show that the prosecution has proved its case of demand of the amount by the accused.

2 apeal508.18 The learned A.P.P. has pointed out para Nos. 18 and 19 of the impugned judgment and has submitted that the Special Court has considered all the relevant aspects properly. After hearing the rival submissions and going through the impugned judgment, I am not convinced that the prayer made in this application for suspension of sentence can be granted.

However, office is directed to list the appeal for final hearing as soon as the appellant supplies private paper book.

The criminal application is dismissed accordingly.
