The applicants have apprehension of arrest in Crime No.176/2025 registered with Police Station, Chamorshi, District Gadchiroli for the offences punishable under Sections 83, 98 and 65(a) of the Maharashtra Prohibition Act, 1949.

It is the case of the prosecution that on receiving information about the vehicle carrying liquor which is going towards Gadchiroli where the liquor is ban. Accordingly, the raid was conducted. The vehicle was found, all the three applicants ran away from the spot. The liquor was seized. The vehicle was also seized. 4.
The learned Counsel for the applicants has stated that there are similar offences registered against all the three persons and they are released on bail. The applicants are ready to co-operate the investigation. Hence, prayed to protect them by granting anticipatory bail.

The learned A.P.P. opposed the application stating that all the three persons were present on the spot
2 41.aba.626.25 and they ran away. The vehicle is taken in custody. The custody of these applicants is required to verify who is the owner of the said vehicle. The similar crimes are registered against all the applicants. During the period they have released on bail, they have committed same offence. Hence prayed to reject the application.

Heard both the learned Counsel for the parties. 7.
The applicants have apprehension of arrest in Prohibition Act. The similar offences are registered against them. The presence of the applicants at the time of raid is not denied by the applicants.

Considering the allegations made against these applicants and as the liquor is seized, the custodial interrogation of these applicants is not necessary. The case is made out to release the applicants on anticipatory bail. Accordingly, I pass the following order:
i] It is directed that in the event of arrest of the applicants namely applicant No.1. Shankar Sukhdev Roy, applicant No.2 Shrikant Subhash Boinwar and applicant No.3 Debrat Subhash Dhali in connection with Crime No.176/2025 registered with Police Station, Chamorshi, District Gadchiroli for the offences punishable under Sections 83, 98 and 65(a) of the Maharashtra Prohibition Act, 1949, they be released on bail on furnishing P.R. Bond in the sum of Rupees Twenty Five Thousand each with one solvent surety each in the like amount.
3 41.aba.626.25 ii] The applicants shall not in any way tamper with the prosecution evidence.
iii] The applicants shall not pressurize or threaten the prosecution witnesses.
iv] The applicants shall attend the concerned police station on every Monday and Saturday between 1:00 p.m. to 2:00 p.m. till filing of the charge-sheet.
v] The applicant shall co-operate the investigation officer.
