The learned counsel for the petitioner, on instructions, seeks leave to withdraw the present petition with liberty to file appeal against the orders impugned. 2.

The learned counsel for the petitioner submits that the petitioner has already deposited the amount of penalty imposed by the Tahsildar. It is submitted that the petitioner without prejudice to his rights is willing to deposit 50% of penalty amount imposed by the Sub-Divisional Officer and subject to the said deposit, the vehicle in question be released as the livelihood of the petitioner is dependent upon the said vehicle.

The total amount of penalty is Rs.1,00,000/-. In the facts and circumstances of the case, the respondent no.3 - Tahsildar, Ghatanji shall release the vehicle in question, subject to deposit of Rs.50,000/- by the petitioner with the office of the Tahsildar, Ghatanji.

The petitioner shall execute the bond before the respondent no.3 - Tahsildar, Ghatanji in terms of Section 47 of the Maharashtra Land Revenue Code, 1966.

If the appeal against the orders impugned is filed within a period of two weeks from today, then it shall be treated as filed within a period of limitation. 6.
