The challenge is to the registration of FIR under section 54 (2) of the Maharashtra Regional and Town Planning Act, 1966.

The Planning Authority has lodged complaint that the statutory notices issued are being ignored, and the construction, which according to the Planning Authority is ongoing, is illegal.

We indicated to the learned counsel that the application is premature in as much as even according to the learned counsel the notices issued by the Planning Authority are sub judice before the Coordinate Bench.

In this view of the matter, the learned counsel for the applicant seeks leave to withdraw the application with liberty to challenge the registration of FIR, if there is any

The application is disposed of as withdrawn, with liberty as prayed.
