It is not necessary to issue notice to the respondents on the civil application as the respondents were not represented in the Court on 19.9.2016 when the first appeal was dismissed for want of prosecution.

For the reasons stated in the application, the first appeal is restored to file, subject to payment of costs of Rs.750/- (Rupees Seven Hundred Fifty Only) to the High Court Bar Association, Nagpur within one week.

The Misc. Civil Application is allowed in the aforesaid terms and disposed of.
