Considering the submission that the order of dismissal of the complaint dated 30.6.2017 was passed at a time when the mediation proceedings were going on about which the respondent had full knowledge and yet it was not brought to the notice of learned Mediator, I am of the view that this application deserves to be allowed. Application is allowed. Leave to file appeal is granted. Application is disposed of. Appeal be registered.

Criminal Appeal : Issue notice of final disposal to the respondent at the admission stage itself, returnable on 31.1.2018.
