Date : 23 rd NOVEMBER, 2015 Heard Advocate Marathe for the petitioners and Shri Fulzele, learned APP for the State.

Advocate Marathe attempts to demonstrate that on the date on which Shankar Pat was allegedly held at mouza Sawalkheda, the police authority forcibly took the petitioners and several other persons to the police station and illegally snatched away the amount running into several thousands of rupees from each of them. When the petitioners made a representation to the superior police authorities, he submits that only to harass the petitioners, a notice under Section 160 of Code of Criminal Procedure has been issued on 22.9.2015.

2311wp819.15 APP points out that F.I.R. has been registered on 16.8.2015 itself.

Several disputed questions of fact arise. The petitioners have been called upon to assist the police machinery. In this situation, if there is any undue harassment, the petitioners can make grievance about it before competent forum.

Therefore, without observing anything on merit and keeping all the contentions open, we dispose of the writ petition. No costs. JUDGE JUDGE /TA/
