After arguing for sometime, the advocate for the applicant, on instructions, seeks permission to withdraw the application. It is disposed as withdrawn.

The learned Additional Sessions Judge, while dismissing the application filed by the applicant under Section 439 of the Code of Criminal Procedure has observed that the advocate for the applicant had stated that he is not having any instructions to request the Court for expeditious trial. Recording the submission made by the advocate for the applicant, the learned Additional Sessions Judge has left it to the parties to request for expeditious disposal of the trial. It is brought to the notice of the learned Additional Sessions Judge that expeditious disposal of the trial cannot be only at the mercy of the parties but it is the duty of the Court also to conclude the trial expeditiously, if it thinks so. The Court is not helpless in the matter.

The learned Additional Sessions Judge shall expedite the trial and conclude it within one year. JUDGE RRaut..
