DATED : NOVEMBER 19, 2019 Heard Mr.Parchure, learned counsel for applicant. He submits that he is challenging order dated 02.07.2019, passed by learned Judicial Magistrate First Class, in Regular Criminal Case No.130/2019, whereby summons are issued to the applicant.

In my view, since the applicant has not exhausted the remedy of filing of revision and since it is my consistent view that before approaching this Court the litigant should exhaust the alternate remedy, the present application is disposed of with liberty to the applicant to file revision before learned revisional Court challenging the said order. If such a revision is filed within a period of 10 days from today and if it is found that it is barred by limitation and the application is accompanied with an application for condonation of delay, it is expected from the learned Judge of the revisional Court to consider the factum of pendency of the present application before this Court.
