This court, in similar matters has taken a view that if the claimants are willing to forgo the interest on the enhanced compensation, delay though inordinate could be condoned by this Court.
This is a similar case and therefore, if the claimant is willing to forgo the interest, this application shall deserve similar consideration.
The application is allowed. The delay of 1213 days is condoned subject to the
ca606of17.odt condition that the interest on enhanced compensation from the date of impugned judgment and order till today, if enhanced compensation is granted, shall not be claimed by the claimants. Necessary undertaking in this regard be filed by the claimant within one week.
Appeal be registered after filing of necessary undertaking.
