A statement was made on behalf of the appellant that if the effect and operation of impugned judgment is not suspended and appellant is not granted bail by this Court, the appellant would be surrendering before the Sessions Court on 27th August, 2018 itself. The submission made on behalf of the appellant is recorded in the order dated 27th August, 2018.

Today, it is submitted that the appellant, though was present in Court premises has not surrendered as assured.

Considering the conduct of the appellant and the facts of the case, the criminal application is dismissed.
