In view of this statement made by the learned A.P.P., Mr. Patil, learned counsel for the applicant submits he be permitted to withdraw the present application with liberty to file bail application afresh before the Court below. The application is permitted to be withdrawn with liberty to the applicant to file application for bail afresh in view of the change in the circumstance i.e. filing of the charge-sheet. It is made clear that this Court has not heard the matter on its own merit.
