Narwade, Advocate for applicant.

CORAM : R.M. Joshi , J.

DATE : 16-06-2025.

None for the respondent, though served.

2.

Applicant is a lady, presently residing at Mangrulpir, District Washim. It is her case that she has no independent source of income and she is dependent on her parents. It is also contended that there is no one to accompany her to attend the Hindu Marriage Petition No.72/2024 filed by husband at Buldhana.

3.

Learned Counsel for the applicant submits that circumstances in which the petition is filed indicate that if the non-applicant is compelled the applicant to contest the proceedings before the Court at Buldhana it will lead to cause injustice.

4.

For want of challenge to the case sought to be made out by the applicant, her contentions deserve to be accepted.

2 mca 828.24.odt This Court find, substance in submissions on behalf of applicant that if she is caused upon to attend the proceedings at Buldhana, prejudice is likely to cause to her defence. No prejudice is likely to be caused to the non-applicant if application is allowed. Hence, the application is allowed in term of prayer Clause (A). (R.M. Joshi , J.
