OCTOBER 17, 2025 1) The present petition is directed against the order dated 01/01/2024 passed by Joint Civil Judge Senior Division, Nagpur below Exh42 in Spl.C.S.No.200076/2013, whereby the application filed by the defendant No.1 for setting aside no cross order was assailed.

2) I have gone through the impugned order passed by the learned Trial Court. The learned Trial Court rejected the application on the ground that in spite of sufficient opportunity granted to the petitioner, he failed to cross-examine the witness. 3) In view thereof, in the interest of justice, to afford one more opportunity to the petitioner the impugned order dated 01/01/2024 below Exh.42 passed by learned Trial Court is hereby quashed and set aside subject to costs of Rs.5000/- to be paid to High Court Bar Library.
