The grievance raised in this contempt petition is with regard to the noncompliance of the directions issued by the Nagpur and Wardha District Mathadi and Unprotected Labour Board, Nagpur by its order dated 05.03.2015. The Board had directed the Senior Plant Manager of the Indian Oil Corporation Limited to deposit the amount of due wages and other amount as directed in Recovery Petition No.1 of 2014. A further direction was issued to give preference to the respondent nos.5 to 24 in those proceedings by way of restitution on the former post as earlier. Writ Petition No.5623 of 2016 filed by the Indian Oil Corporation Limited, Nagpur challenging aforesaid directions came to be dismissed on 22.01.2018 and this order was thereafter upheld by the Hon'ble Supreme Court on 16.07.2018.

Today, affidavit has been filed on behalf of the Indian Oil Corporation Limited by its Plant Manager in which it is stated that the amount of wages that were due and payable had been deposited with the Board. A further statement is made that as directed by the Board, preference would be given to the petitioners for restitution of the work as directed. The affidavit as submitted is treated as an undertaking to the Court and is accepted.

In view of aforesaid, we are satisfied that the orders passed by the Board stand complied with. It is not necessary to keep the present proceedings pending. The contempt petition is disposed of.
