1] Pursuant to the order of this Court dated 18.7.2019, the respondent considered the claim of the petitioner for the position of Superintending Engineer. By an order dated 4.12.2019, the claim for promotion to the said post was rejected.

2] The learned Advocate for the petitioner, however, submits that his basic claim is to the post of Executive Engineer w.e.f. 2002 as he has been superannuated in 2014 after the judgment of the learned Single Judge dated 30.9.2014 delivered in Writ Petition No.3310/2003 which is with reference to the judgment of the Industrial Court dated 25.4.2003 vide which, Complaint (ULP) No.822/1997 filed by the petitioner, was allowed.

2 wp8210.17 3] As such, this matter involves a service dispute and keeping in view that the petitioner is 58 years of age today and his retirement is scheduled in April 2020, we find this to be a good reason to list this petition for final hearing at admission stage on 27.2.2020. The parties shall note that a request for adjournment would not be entertained, unless on account of unforeseen circumstances.

4] In view of the above, Civil Application No.3347/2019 stands disposed off.
