The petitioner has approached this Court praying for setting aside the tender process issued vide tender notice dated 5.8.2016 and also for a declaration that certain conditions in the corrigendum are illegal. The petitioner is a member of the Municipal Council, Gondia. The petitioner is not a person who had participated in the tender notice. On account of the interim order passed by this Court dated 28.9.2016 the issuance of work order has been stalled.

To a pertinent query, Shri M.I. Dhatrak, learned Counsel for respondent no.3, states that in most of the tenders 3 to 4 bids have been received by the Municipal Corporation. He submits that wherever the number of bids is one or two, the Municipal Council itself has decided to re-tender.

25.10WP.5646.16 In that view of the matter, we find that the petition as filed by the present petitioner is without any locus. The petition is, therefore, rejected on this short ground. Judge Judge J.
