DATED : 01/02/2021 1] Learned APP invited our attention to the letter dated 20/12/2018 issued by the Assistant Commissioner of Police, Sadar Division, Nagpur City to the Special Court, MCOCA, Nagpur informing that in absence of sufficient evidence against the present applicant, it has been decided to file charge-sheet against the applicant under the Indian Penal Code offences and not under the provisions of the Maharashtra Control of Organized Crime Act (MCOCA). 2] In view of the decision of the Investigating Agency to drop the proceedings under the provisions of the MCOCA against the applicant, Shri Dable, Advocate appearing for the applicant, on instructions, sought permission to withdraw the present application with liberty to the applicant to proceed with the pre-arrest bail application which has been filed by the applicant and which is pending with the Special Court, MCOCA, Nagpur.
