At the outset, learned counsel for the petitioner seeks leave to withdraw this writ petition with liberty to file a criminal revision application before the Sessions Court. The petition is accordingly disposed of as withdrawn with liberty as prayed for.

If such an application is filed, the learned Judge shall take into consideration the pendency of this writ petition, in this Court, while considering the delay caused in filing the revision application.

It is made clear that this petition has not been heard on merits.
