On perusing the typed copy of the roznama, marked "X" for identification, produced before the Court and taken on record, it is seen that after this applicant was taken in custody by the trial Court on 02/6/2016, some efforts were made by the trial Court for effectively commencing the trial. However, the efforts could not meet with success as the prosecution had not filed on record the programme. On two dates, the State did not produce the accused before the Court, who is in jail custody. Though, it appears that the accused did not cooperate in expeditious disposal of the case, the State also did not take the matter seriously. The question would, therefore, as to how long this would go on.
In these circumstances, it would be better that one more opportunity is given to the applicant by releasing him on bail even on more stringent conditions. Hence, the order. The application is allowed and it is directed that the applicant be released on bail on his furnishing a P. R. Bond in the sum of Rs.50,000/- together with two solvent sureties of Rs.25,000/- each on the conditions that; (1) the applicant shall attend the court proceedings on the dates fixed in the matter unless exempted from personal exemption by the trial Court, in accordance with law, (2) shall cooperate with the trial Court in expeditious disposal of the case, and (3) shall not tamper with the prosecution witnesses.
