"The petitioner is concerned with the contribution of provident of provident fund for the period prior to the year 2015. However, he has challenged the order passed by respondent no.1 issuing direction to the respondent no.2 to deposit provident fund for the period from 2017 onwards. The petitioner shall justify filing petition.
Learned counsel for the petitioner seeks time to take instructions.
List in the week commencing from 1410-2024."
The petitioner could not justify filing petition.
At the request of learned counsel for the petitioner, one more opportunity is given, but as a last chance.
List on 3-12-2024, high on board."
Counsel for the petitioner submits that main grievance was that opportunity of hearing was not given to him. He has invited my attention to the impugned order, which
28-WP-2131-2023 indicates that respondent No.1 has only heard the authority. Counsel for the respondent No.1 seeks time to have instructions.
Stand over to 10.12.2024."
Learned counsel for respondent no. 1 seeks time to file affidavit in compliance to aforesaid order. Time granted.
Learned counsel for the petitioner submits that the petitioner has taken back the brief. Pursis to that effect has been filed and accordingly, he seeks discharge.
Since the petitioner has taken back the brief, Advocate Mr. K. S. Motwani appearing for the petitioner stands discharged.
The petitioner has not engaged another counsel. List the petition for 'dismissal' on 1912-2024. Learned counsel Mr. K. S. Motwani, who appeared for the petitioner, shall inform the petitioner of the order passed by this Court. In addition, Registry shall serve copy of this order on petitioner.
In the meantime, respondent no. 1 may file affidavit."
