Heard Shri K.S. Narwade, learned counsel for applicant-respondent no.1, Shri V.G. Palshikar, learned counsel for appellant and Ms. H.N. Jaipurkar, learned AGP for respondent nos.2 and 3.

Having considered the reasons given in the impugned judgment and order, I am of the view that this application can be conditionally allowed. The application is allowed. Respondent no.1-claimant is permitted to withdraw 75% of the amount deposited in this Court against usual undertaking and remaining 25% of the deposited amount against solvent surety both to the satisfaction of the learned Registrar (Judicial) to be furnished within four weeks from the date of the order.

Civil Application stands disposed of accordingly.
