DATED : OCTOBER 7, 2019 This is an application for bail. The applicant is arrested on 28.08.2019 in connection with Crime No.512/2019, registered with Police Station, Nandura, Dist. Buldhana for an offence punishable under Sections 498-A and 306 of the Indian Penal Code.
Heard Mr.Sirpurkar, learned counsel for applicant and Mr. Jawade, learned A.P.P. for non applicantState. Also perused the reply filed on behalf of the State. Initially, on the basis of the report lodged by the present applicant on 19.08.2019, an AD was registered by Police Station, Nandura in respect of unnatural death of his wife Seema vide AD No. 44/2019.
On 22.08.2019, father of deceased Seema lodged report, making allegations against the present applicant and family members of the applicant that they used to demand dowry, used to ill treat physically and mentally the deceased and therefore she has committed suicide. The relatives of applicant are already released on bail.
ba886.19.odt Looking to the prosecution case, as disclosed in the reply, in my view, the applicant can be released on bail. Hence, I pass the following order.
ORDER
(i) The application is allowed.
(ii) Applicant-Manoj Bhaskar Kharate be released on bail in connection with Crime No.512/2019, registered with Police Station, Nandura, Dist. Buldhana for an offence punishable under Sections 498-A and 306 of the Indian Penal Code, on he executing P.R. Bond in the sum of Rs. 25,000/- with one solvent surety in the like amount. (iii) Applicant shall attend Police Station, Nandura, once in a week i.e. on every Sunday till filing of the chargesheet and after filing of the charge-sheet during the pendency of the trial, he shall attend Police Station, once in a month i.e. on last Sunday of every month and shall be with the investigating officer from 11:00 a.m. to 05:00 p.m. The application is disposed of.
