Mr. Dhande, learned counsel for the petitioner, vehemently opposed the application on number of grounds. He submitted that the application is not tenable in the teeth of the provisions of the Companies Act which do not even now provide for interdiction by any other person than the categories of person mentioned in the provisions of Section 454 and 457 of the Companies Act.
In my opinion, the submissions made by Mr. Dhande to oppose the application do not sound legal and proper because the applicant submits that he has purchased the property in respect of which the Liquidator has stuck a notice on the property with an intention to take possession and symbolic possession has allegedly been taken.
cao1852.15 In view of above, Civil Application No. 1852/2015 is allowed. Necessary amendment be carried out within a period of one week.
