The order of the Labour Court on the issue of fairness of enquiry is reversed by the Industrial Court. 3.

Since I was not inclined to entertain the petition, the learned Counsel Shri A.A. Dhawas for the petitioner seeks leave to withdraw the petition.

The petition is disposed of as withdrawn.

The Labour Court shall proceed with the complaint and shall decide the remaining issues i.e. whether the findings are perverse and the proportionality of the punishment, and shall endeavour to conclude the proceedings within six months.
