CORAM : SMT. VASANTI A. NAIK AND MRS. SWAPNA JOSHI, JJ.
DATED : JULY 22, 2016.
Shri Shende, the learned counsel for the petitioners, states that he is not in a position to work out this petition as the case papers are returned to the petitioners and probably they have engaged another counsel.
By this contempt petition, the petitioners seek action against the respondent nos.1 and 2 in not complying with the orders, dated 7.7.2014 and 21.4.2015.
It was the case of the petitioners that despite the statement made by the management that it would pay an amount of Rs.15,000/- per month for the period during which the petitioners actually rendered services, the said order is not complied with. According to the petitioners, the order dated 21.4.2015 is also not complied with, as the management council has not taken any decision as per the directions in the said order. It is stated on behalf of the respondents that the management council has re-decided the matter in the case of the petitioners and a writ petition is filed by the management council against the said decision. It is stated that, by the order dated
2 cp354.15.odt 21.4.2015, the management council was directed to decide the matter and the said order is complied with. It is stated on behalf of the respondent nos.2 and 3 that though there was some delay in making the payment at the rate of Rs.15,000/- per month, as per the direction in the order dated 7.7.2014, the order stands complied with, as the petitioners were paid the arrears at the rate of Rs.15,000/- per month for the period during which they had actually worked.
By accepting the statement made on behalf of the respondents, we dispose of the contempt petition, with no order as to costs.
