Kumar, appearing on behalf of the appellant seeks permission to withdraw the present appeal by filing Form No. "N" to that effect along with terms of compromise. It is marked as Exh. "X" for identification. Respondent absent. No cross appeal / objection on behalf of respondent reported to be pending. No sufficient reason for refusing withdrawal of appeal. Hence, allowed to withdraw the appeal. 2] Respondents are allowed to withdraw the amount deposited in the Court, with accrued interest, if any.

3] Appellant to inform the respondent, immediately about this order. 4] The appeal is thus allowed to be withdrawn in terms of pursis "X". 5] The admissible court fee, as per the rules, be refunded to the appellant.
