The prayer made on behalf of the respondent/ employee for permission to withdraw the amount deposited by the petitioner cannot be granted as after hearing the parties this Court directed that the amount be kept in fixed deposit in the nationalized bank.

Considering the pendency of the writ petitions of the earlier years and the fact that the reason given by the respondent/ employee for grant of early hearing is not sufficient to hear the matter out of turn, the prayer for grant of early hearing also is not considered at this stage. The civil application is dismissed with liberty to the respondent/ employee to reiterate the prayer for grant of early hearing after six months.
