For the reasons stated in the application, the application is allowed. Necessary amendment be carried out within one week. Respondents are at liberty to file counter affidavit to the amended petition, if they so desires. Application is disposed of. WRIT PETITION NO 5569 OF 2024 Heard.

At this stage, Mr. Agrawal, learned counsel for respondent Nos. 3 and 4 points out that respondent No.1 is not deciding the application of respondent Nos. 3 and 4 filed under Section 258 of the Maharashtra Municipal Corporation Act, because of pendency of this petition. It is pointed out that there is no such direction prohibiting the authorities to decide the above referred application. 3.

List this matter after three weeks, for final disposal. Needless to mention that the authorities are free to proceed with the application filed under Section 258 of the Maharashtra Municipal Corporation Act, since there is no stay or any other prohibitive order.
