DATED : SEPTEMBER 26, 2019 Heard Mr. Rai, learned counsel for the applicant and Mr. Ghodeswar, learned A.P.P. for non applicant-State. Applicant is arrested on 23.05.2011 in connection with Crime No.157/2019 registered with Police Station, Bhisi, Tq. Chimur, Dist. Chandrapur for an offence punishable under Sections 306, 304-B, 498-A and 34 of the Indian Penal Code.

The investigation is over and charge-sheet is already filed.

Applicant is husband of deceased Poonam. Their marriage was solemnized on 22.05.2015. Poonam committed suicide on 21.05.2019 by hanging herself at her matrimonial house. On 23.05.2019, Kawadu, father of the deceased, lodged report against the applicant and other accused persons. Gist of the accusation is that the accused persons used to demand money and fed up with that he has committed suicide.

ba869.19.odt The applicant is in jail since 23.05.2019. The investigation is over. There is a delay of two days. Though, the said can be explained at the stage of trial, it will have to be given importance at this stage.

In that view of the matter, I pass following order.

ORDER

(i) The application is allowed.

(ii) Applicant-Amol Ravindra Barsagade, be released on bail in connection with Crime No.157/2019 registered with Police Station, Bhisi, Tq. Chimur, Dist. Chandrapur for an offence punishable under Sections 306, 304-B, 498-A and 34 of the Indian Penal Code, on he executing P.R. Bond in the sum of Rs.10,000/- with one solvent surety in the like amount.

(iii) Applicant shall attend Police Station, Bhisi once in a month i.e. on last Sunday of every month, till culmination of the trial.

The application is disposed of.
