Heard learned counsel for applicant and learned A.P.P. for State-non-applicant.

The applicant is arrested on 14/8/2017, in connection with Crime No.500/2017, registered with P.S. Ghughus,District-Chandrapur, for the offence punishable under Sections 65(a) of Maharashtra Prohibition Act and Section 188 of the Indian Penal Code.

Though the application is opposed by the learned A.P.P. on the ground that the investigation is in progress, learned A.P.P. fairly submits that it is on the verge of the completion and in the near future chargesheet will be presented before the Court of law.

The applicant was arrested on the spot. He was driving the vehicle in which liquor was transported within Chandrapur District.

All the liquor and vehicle is already seized. The applicant is in jail since 14/8/2017. Since the investigation is on

ba.882.17.odt the verge of the completion, in my view, the further incarceration of the applicant in jail is not required. That leads me to pass the following order.

ORDER

I) Application is allowed.

II) Applicant Ajit S/o Bhaurao Hanumante be released on bail in connection with Crime No.500/2017, registered with P.S.Ghughus,District-Chandrapur, for the offence punishable under Sections 65(a) of Maharashtra Prohibition Act and Section 188 of the Indian Penal Code, on he executing P.R.Bond of Rs. 5000/- with one solvent surety in the like amount. III) Applicant shall attend P.S.Ghughus, DistrictChandrapur once in a month preferably on 1st Sunday of every month till filing of the chargesheet. IV) The application is disposed of.
