Shri R.K. Joshi, learned counsel, waives notice for non-applicant.
While deciding the Second Appeal on 29th June, 2017, the applicant was granted time to vacate the suit premises by 30th September, 2017. By this application it is prayed that said time be extended by a further period of six weeks.
Shri Joshi, learned counsel for the non-applicant,
submits that this extension of time may be granted as a last opportunity and with the understanding that no further time would be sought by the applicant. Considering reasons mentioned in the application, the time to vacate the suit property is extended till 12th November, 2017. The undertaking filed by the applicant on 6th July, 2017 shall be treated as an undertaking by which the suit premises would be vacated by 12th November, 2017.
Civil Application is disposed of.
