(Passed on 09.09.2023) The appellant-Insurance Company is present through it's Counsel Mr. D.N. Kukday. None present for the respondents. The appellant has filed pursis stating therein that the appellant does not want to proceed with the case. The appellant stated that Rs.12,65,688/- deposited by the appellant and the interest threon, if any, be paid to the claimants and the court fees, admissible under Rules be refunded to the appellant. In view of the fact that, the appellant does not want to proceed with this appeal, this appeal is hereby disposed of, as withdrawn. The respondents/claimants are hereby given liberty to withdraw the amount as per order of the Trial Court.

The requisite court fees, if any, be refunded to the appellant, as per Rules.
