DATE : 07-06-2022 This is a second application for grant of bail under Section 439 of the Code of Criminal Procedure. Earlier bail application was withdrawn after the Court had expressed its disinclination to grant bail. However, liberty was granted to approach this Court after six months, if the trial is not commenced.

Learned APP has pointed out the criminal antecedent, thereby, it is pointed out that there are three offences registered against the applicant of similar in nature. In that view of the matter, on expressing disinclination to grant the present application, learned Counsel for the applicant seeks permission to withdraw the present application with a request to direct the learned trial Court to expedite the matter.

Permission is granted as prayed for to withdraw the present application.

The applicant is in jail since December, 2020 and the other co-accused are released on bail. In these circumstances, the trial Court is requested to expedite the trial and complete the same, in any case, within next nine months. 5.
