The applicant has apprehension of arrest in Crime No.227/2025 registered at Police Station City Kotwali, District Akola for the offence punishable under Sections 318(4) of the Bharatiya Nyaya Sanhita, 2023. 3.

The allegations made against this applicant are that there is a business transaction between the applicant and the complainant/first informant. The complainant handed over the gold to the applicant for making jewelry. It is alleged that after taking the gold, the applicant ran away and therefore, the offence is registered. Thereafter, the applicant has given the cheque of Rs.5,00,000/- to the complainant. The said cheque was dishonoured. 4.

The learned Counsel for the applicant has stated that the applicant's intention was not to dupe the first informant, still he is ready to return the gold, 35 grams on 30.10.2025 and 35 grams on 30.11.2025. 5.

The complainant/first informant has no objection, if the applicant is returning the gold. 6.

Considering the allegations made against the applicant and as the applicant is returning the gold to the

2 9.aba.621.25 complainant, the applicant is protected by granting anticipatory bail. Accordingly, I pass following order : i] It is directed that in the event of arrest of the applicant in connection with Crime No.227/2025 registered at Police Station City Kotwali, District Akola for the offence punishable under Section 318(4) of the Bharatiya Nyaya Sanhita, 2023, he shall be released on bail on furnishing P.R. Bond in the sum of Rupees Twenty Five Thousand with one solvent surety in the like amount.

ii] The applicant shall not in any way tamper with the prosecution evidence.

iii] The applicant shall not pressurize or threaten the prosecution witnesses.

iv] The applicant shall attend the concerned police station twice in a week i.e. on Monday and Saturday between 1:00 p.m. to 2:00 p.m.

and co-operate the Investigating Officer.

v] If the applicant fails to return the gold as per his undertaking, the police can take custody.

The application stands disposed of.
