Heard Shri A.K. Bhangde, learned Counsel for the applicant/appellant and Shri N.B. Jawade, learned A.P.P. for respondent - State. 2.

We find from the discussion on evidence of P.W.4 -Firoz Khan, that in earlier incident he saw the present applicant (accused no.3) obstructing one Alim (victim), in front of Lucky Chicken Center. A blow of sword was delivered on Alim there, and Alim thereafter ran towards Hasanbagh Chowk. Accused no.3 and accused no.4 followed him on motor cycle. This

Order 2110appa650.16 event therefore, show that some material is available against the applicant/accused no.3 on record.

Appeal is to come up for final hearing on 16.11.2016, as per earlier orders passed by this Court on 15.09.2016 (In Criminal Appeal No. 435/2015).

In this situation, we are not inclined to allow this Criminal Application. The same is rejected. No costs.
