SEPTEMBER 25, 2017 Heard Mr. S. S. Sitani, Advocate for applicant and Mr. V. Gangane, A.P.P. for non applicant-State. The applicant is arrested in connection with Crime No.806/2017 registered with Police Station, Rajura, Dist. Chandrapur for an offence punishable under Sections 394 read with Section 427 of the Indian Penal Code.

It is brought to my notice that the co-accused Kasim Yunush Sheikhh is already released on bail vide order dated 08.09.2017.

The learned counsel for the applicant submitted that the role that is attributed against the present applicant is identical to the role attributed to Kasim Yunus Sheikh who is already released on bail. This particular submission is not disputed by the learned counsel A.P.P.

ba889.17.odt In that view of the matter, the applicant is entitled to be released on bail on parity. Therefore, for the reasons stated in Criminal Application No.835/2017 filed by Kasim Yunus Sheikh, the present applicant is entitled to be released on bail.

ORDER

(i) Criminal Application No.889/2017 is allowed.

(ii) Applicant-Sheikh Hussain Sheikh Gafur, be released on bail in connection with Crime No.806/2017 registered with Police Station, Rajura, Dist. Chandrapur for an offence punishable under Sections 394 and 427 of the Indian Penal Code, on he executing P.R. Bond in the sum of Rs.25,000/- with two solvent sureties in the like amount.

(iii) The applicant shall attend Police Station, Rajura, Dist. Chandrapur once in a week i.e. on every Saturday between 3.00 p.m. to 5.00 p.m. till the chargesheet is filed. The application stands disposed of.
