By this writ petition, the petitioner has challenged the judgment and order passed by Judicial Magistrate First Class, Nagpur, in Summary Criminal Case No. 15751 of 2014, which was confirmed in Criminal Appeal No. 155 of 2017, convicting present petitioner for the offence punishable under Section 138 of the Negotiable Instruments Act and sentencing him to suffer simple imprisonment for a period of one month and also to pay compensation of Rs. 1,40,000/- under Section 357 of the Code of Criminal Procedure, 1973.

During pendency of this writ petition, both parties arrived at a settlement. The respondent has already received an amount of Rs. 1,00,000/-, and today, demand drafts of Rs. 56,000/- and Rs. 1,24,000/- have also been received by the original complainant / rkn

942wp689.2025.odt respondent. The terms of settlements are already filed on record. Both parties are present before this Court, and the contents of the settlement terms have been verified. They have accepted the settlement terms . In view of the above, the writ petition is to be disposed of by acquitting the present petitioner. Hence, I proceed to pass the following order.

ORDER

a] In view of the settlement, writ petition is disposed of and the petitioner is acquitted from the charges.

b] The petitioner is also entitled to receive the amount of Rs. 56,000/- which is deposited before the Additional Sessions Judge-9, Nagpur.

c] The amount be returned to the petitioner on due identification and verification.
