The applicant is arrested in Crime No. 242 of 2025 for the offence punishable under Sections 75 (2) and 351 (2) of the Bharatiya Nyaya Sanhita.

The first informant has made the allegations against this applicant, who is the manager in Royal Enfield Motor Showroom. The applicant was working there as a receptionist. She has made allegations that the applicant was looking towards her with bad intention. She informed it to the owner of the said showroom. The owner has stated that being a manager she has to follow his instruction. Thereafter she has made allegation that he asked her for the Sexual favours and she informed about it to the owner. Said allegations were made in year November 2024. Thereafter, she was asked to work at the place which is back side of the office and she refused for it and, thereafter, the owner has removed her. Thereafter she has lodged the complaint against this applicant and the crime is registered.

The Learned APP opposed the application stating that the this is a case of harassment at work place. Her husband is disabled and she has to work for her livelihood. The applicant asked her for sexual favours and she denied for it and, therefore, she is removed from job. Considering the gravity of offence prayed to reject the application. 5.

Heard both counsels and perused the record. It appears that applicant was removed by the owner of the showroom as she has not followed the instructions. Considering the fact that the allegations made are of year 2024 and after her removal she has made allegations against the applicant who has not removed her the case is made out to release the applicant on bail.

i) Criminal application is allowed.

ii) Applicant - Gajanan S/o Pandurang Kavadase @ Patil be released on bail in Crime No. 242 of 2025, registered with MIDC Police Station, Akola, Tq. And Dist. Akola for the offence punishable under Sections 75 (2) and 351 (2) of the Bharatiya Nyaya Sanhita, on his furnishing P.R. Bond in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand only) with one surety in the like amount.

iii] The applicant shall not in any way tamper with the prosecution evidence.

v] The applicant shall co-operate the investigation officer.

The Criminal Application stands disposed of accordingly.
